NMa
As chief general counsel of the Netherlands Competition Authority (NMa), professor Smits has been responsible for overseeing the preparation of new fining guidelines for infringements of competition law and energy and transport law, the enforcement of which has been entrusted to NMa, resulting in the adoption of the NMa Fining Code 2007. He also contributed to the adoption by the European Competition Authorities of the Principles for convergence in respect of pecuniary sanctions imposed on undertakings for material infringements of antitrust law.
Among his areas of focus is the process initiated by the European Commission towards more effective private enforcement of competition law in Europe.
